AFRICA BASKETBALL ACADEMY (ABA) PARENT CONTRACT

This Agreement sets out the terms and conditions governing the participation of your child in the Africa Basketball Academy (ABA). By completing the online registration process, you, as the Parent, Guardian, or Payer (collectively referred to as the “Member” or “You”), agree to abide by the terms outlined below.

1) Late or Non-Payment

• Late payments may result in suspension of training and game participation.
• If fees remain unpaid beyond the due date, ABA reserves the right to refer the outstanding balance to debt collection, and the Parent/Guardian will be liable for all associated legal and administrative costs
• ABA may apply a late payment penalty fee for overdue accounts beyond 7 days.

2) Missed Lessons

Missed lessons are non-refundable and cannot be credited toward future payments.

3) Monthly Membership Cancellation

One full calendar month’s written notice is required before cancellation.
Failure to provide notice results in liability for the next month's fees.
Partial refunds for mid-month cancellations are not available.

4) Exclusion for Non-Payment

ABA reserves the right to suspend or exclude a child from training and/or games if:
- Fees remain unpaid by the due date.
- Membership has been terminated or suspended due to non-payment.
- The child has been removed from ABA following a disciplinary process.

5) Health and Fitness Declaration

• The Parent/Guardian confirms that the child is in good health and capable of engaging in basketball training.
• ABA staff are not medically trained, and parents should seek professional medical advice if there are any health concerns regarding their child’s participation.

6) Risk Acknowledgment

• Basketball is a physical sport, and participation carries inherent risks of injury.
• Participation is voluntary, and parents assume all risks related to training and games.

7) Waiver and Release of Liability

• ABA, its staff, and affiliates shall not be liable for any injury, illness, loss, or damage sustained during training or games.
• Parents waive any right to claim damages resulting from participation in ABA training and activities.

8) Schedule and Changes

• ABA reserves the right to modify training schedules, locations, and game fixtures.
• ABA will provide parents with a season calendar in advance for planning purposes.

9) Force Majeure

No refunds or credits will be issued for cancellations caused by external circumstances, including but not limited to:
- Extreme weather conditions
- Strikes or disruptions
- Government-imposed restrictions (e.g., public health lockdowns)

10) Parental Responsibilities

• Parents must ensure timely payment of fees and adherence to ABA policies.
• Parents are responsible for arranging transportation and any additional expenses related to participation in training, leagues, and games.

11) Protection of Personal Information (POPIA) Consent

In compliance with the Protection of Personal Information Act 4 of 2013 (POPIA), by signing this agreement, you consent to the collection, storage, and processing of your personal information and your child's personal information for the proper management and operation of ABA as a Basketball Academy.

By signing below, you further authorize ABA to use and display photos, images, and videos ("the Data") of your child for marketing, promotional purposes, and showcasing ABA activities, including training sessions, games, and achievements.

You acknowledge that:
- The Data may be shared on ABA’s website, social media platforms, and promotional materials.
- ABA cannot control how third parties may download, share, or reproduce the Data once published.
- You release ABA from any liability arising from the use of such Data as outlined above.

Important: You may withdraw this consent at any time by notifying ABA in writing. Upon withdrawal, ABA will cease using your child's Data for future promotions but cannot remove any previously published content.

12) Agreement Acceptance

By completing the online registration process and making payment, you confirm that you have read, understood, and agreed to all the terms outlined in this Agreement.
